There were good and questionable parts of his recent report. He found a compensable consequence injury to the opposite knee disputed another qme in the case Alex Etimad's finding of no compensable consequence despite the fact that my client ended up having a total knee on the compensating knee. With regard to the CT Dr. Gregg Sobec felt it more credible to apportion to degenerative changes and nothing to years of repetitive dancing, basketball, exercise, stair climbing, unpredictable movements of disabled students placing pressure on my client's already vulnerable knees with disabled students and specific injuries during those years that clearly aggravated my client's knee. If they do not provide a reasonable time and date for the deposition and then set the doctor’s deposition on notice. Yahoo Mail: Search, Organize, Conquer On Mon, May 13, 2024 at 2:32 PM, Christy Mallory (lawnet listserver) < listsender-lawnet@lawnet.caaa.org > wrote: List: lawnet Sent By: Christy Mallory Reply To Sender Reply To List Search Settings Afternoon Everyone, I got a problem....  Got stuck with QME Sonu on a back injury case with drop foot.  I got what I expected for the back, but Sonu ignored the drop foot, so I need to set his deposition.  Sonu is with CMLS.  I followed their instructions to get a deposition date through their portal which was in August at 6:30 pm.  I have an issue with being forced to have a deposition at 6:30 pm.  I contacted CMLS to get an alternative date and was told that I have to schedule through their portal.  If the portal only gives one date, then that means the doctor only has one date.  There is no option available for requesting an alternative date or time.  If I want a different deposition date, I have to "wait a few days" then resubmit my request through the portal.  Technically speaking, I was offered a deposition date within the regulatory timeframe, but the start time of the deposition is the issue.  No one (and I mean no one) should be forced to work beyond reasonable business hours.  I strongly feel that a deposition starting at 6:30 pm is beyond the scope of reasonable business hours as it will likely not conclude until 7:30 or 8:00 pm, which is well after reasonable business hours.  I can wait a few days and put in another request, but also, I am trying to preempt the DA from filing a DOR and get them to settle instead.  I have sent a settlement demand twice with no response.  Anyone have any luck with getting rid of a QME for not having depositions available during reasonable business hours?  Just trying to explore all of my options...
